Covenants

 

The By-Laws of Sun City Texas Community Association, Inc. (the "By-Laws") provide that the Board of Directors of Sun City Texas Community Association, Inc. (the "Association") may appoint a Covenants Committee or deed restriction enforcement committee (hereinafter collectively referred to as the "Covenants Committee") to conduct all hearings regarding violations of the Declaration, the By-Laws, or the Articles (collectively, the "Governing Documents") as provided in Section 4.2 of the By-Laws.

Purpose

This Committee operates under the direction of the Board and is an advisory body only. The Covenants Committee does not have the authority to act for or to bind the association in any way. This Committee conducts all hearings regarding violations and deed restriction enforcement of the Declaration, the Bylaws, the Articles of Incorporation (collectively, the Governing Documents) and Board-established Rules & Regulations. The Covenants Committee prepares a written report to the Board describing any violations of the covenants and enforcement actions.

Responsibilities

The Committee enforces the provisions of the Governing Documents, and Rules and Regulations as set forth in the Declaration. In the event of a violation of the Government Documents or Rules and Regulations, the Board, acting through the Covenants Committee, may take any action set forth in the Governing Documents. The Board may remove or remedy the violation and/or seek injunctive relief, including the imposition of a monetary fine.

Staffing & Qualifications

The Committee consists of five to seven resident members, one non-voting Board Member, and a Neighborhood Representative who serves as an ex officio member. Appointees to this committee should be residents who have backgrounds in the legal field, prior familiarity with master planned community deed restriction & rules enforcement procedures, or who have a general understanding of common law and/or familiarity with the Sun City Georgetown Governing Documents. The Nominating Committee recommends residents to this committee and the CA Board of Directors appoints the members. The members serve staggered terms of two years. The Committee may meet monthly or as often as necessary to do its work, but at least quarterly.

Current Covenants Committee Protocol

The Covenants Committee is made up of five people who are volunteers from the community, and who are appointed by the CA Board of Directors to administer the use/maintenance covenants of Sun City. In doing so, the Committee:
* Considers and decides violations in accordance with adopted procedures
* Develops enforcement procedures
* May withdraw the privilege of the use of the Community Associations common areas from covenants violators
* Considers appropriate sanctions for covenant and design guideline violators
